Contact a Texas Lawyer Regarding Modifications to Court Orders in Family Law
After your Texas divorce, or after your Texas child custody case is complete, changes in individual or family circumstances may lead one party or the other to request a modification to child support or child custody court orders. Typical scenarios where a modification may be under discussion include the following:
- A custodial parent wants or needs to move out of the area because of a job or family situation: transfer, job loss, remarriage or the need to care for elderly parents, for example. The parent therefore requests a modification to the existing child custody and visitation schedule.
- A non-custodial parent may wish to protest or seek to block the move-away or relocation by the custodial parent and the child. He or she wishes to ask the court not to change the existing child custody and visitation court order, or to change primary custody.
- One parent's job schedule has changed significantly — such as that of a pilot who is home for a week and then out of town for a week — and he or she wishes to ask the family law court to modify the custody and visitation schedule to allow for quality parenting time.
- One parent has fallen into drug abuse, gone to prison or otherwise become unfit. The other parent wishes to request a modification giving her or him custody or limiting the visitation of the other parent or having it supervised.
- A parent who is paying child support may have a significant change in income, making an adjustment up or down appropriate.
- A parent who receives child support may report that more support is needed to cope with special needs, such as a medical condition of the child.
A modification of a child custody or child support order may be attainable through negotiations — or may require court hearings, depending on how well parents are willing to cooperate. Speak with a lawyer to learn more about how to pursue and protect the best interests of your child when you or the other parent seeks a modification.
