You will need a probate proceeding if the decedent owned any property that does not transfer by a beneficiary designation. If a person has a will, he/she can dictate how he/she wishes her estate to pass. If a person does not have a will, then the State of Texas makes this determination.

What happens to my debts during probate?
Your executor is responsible for paying all of your debts from assets of your estate.

How much does probate of wills cost?
My fee for a basic probate of a will is $4,000.00 plus expenses

Does the Executor of a will have to be an attorney?
The executor does not have to be an attorney they can be anyone you choose.

Does the Executor of a will have to be a family member?
The executor does not have to be a family member; they can be anyone you choose.
